Terms of Service

1. Agreement to Terms
By accessing or using the Aeviya platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Aeviya LLC ("Aeviya," "Company," "we," "our," or "us") provides an AI-powered hiring platform designed to streamline candidate screening and evaluation.
If you are using the Service on behalf of an organization, you represent and warrant that you are authorized to accept these Terms on that organization's behalf.
2. Description of Service
Aeviya is a hiring and talent platform that may include:
- AI-assisted interviews and evaluations
- Resume parsing and skill extraction
- KPI-based scoring, ranking, and reporting
- Job posting and application management
- Team collaboration and workflow tools
- Optional transactional SMS to candidates who opt in (e.g., interview scheduling and confirmation links)
Features may change over time and may depend on your plan or organization configuration.
3. Accounts, Security, and Access
You are responsible for:
- Maintaining the confidentiality of your credentials and MFA devices
- All activity that occurs under your account
- Ensuring information you provide is accurate and current
- Using the Service only for legitimate recruiting and hiring purposes
You must promptly notify us of any unauthorized use of your account or suspected compromise.
4. Acceptable Use
You may not use the Service to:
- Violate any applicable laws or regulations
- Discriminate against candidates based on protected characteristics
- Upload malware, attempt to bypass security, or probe for vulnerabilities
- Reverse engineer, scrape, or attempt to extract proprietary algorithms or models
- Share access credentials with unauthorized parties
- Use the Service to develop or train competing products using the Service outputs or underlying data
5. AI Features and Limitations
The Service may use AI to generate summaries, scores, recommendations, or other outputs. AI outputs may be inaccurate, incomplete, biased, or not suitable for your particular use case. You are responsible for independently reviewing AI outputs and for all hiring decisions made using the Service.
You agree not to rely on AI outputs as the sole basis for decisions where doing so would be unlawful or inappropriate.
Automated scores and optional integrity or similar signals are provided to support human review. Integrity signals are not intended to automatically change qualification scores and should not be used as the sole basis for adverse action without meaningful human review and a fair process for candidates, as described in our customer agreements and summarized on our Hiring AI compliance page.
Evaluation and scoring features may use automated processes, including multiple passes or refined scoring runs, to produce or review scores and related outputs. We may maintain technical audit records (which may use hashed or summarized identifiers) to support service integrity, troubleshooting, and reasonable program governance. Such technical measures do not, by themselves, establish legal compliance for your organization; you remain responsible for applicable laws and jurisdictions, your hiring practices, and obtaining guidance from qualified counsel where appropriate, as further described on our Hiring AI compliance page.
6. Data, Privacy, and Confidentiality
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
You are responsible for ensuring you have all necessary rights, consents, and notices to collect, upload, and process any candidate data you provide to the Service, including where required by law.
Each party agrees to use reasonable safeguards to protect confidential information and not to disclose it except as necessary to use the Service or as required by law.
Candidate text messages (SMS). Candidates may optionally choose to receive transactional SMS about an application with an employer using the Service (for example, links to schedule or join an interview). SMS is not sent without that affirmative choice on our consent or interview scheduling pages. Employers must not upload phone numbers or solicit texts in a way that bypasses candidate opt-in. Message frequency is typically low (about zero to two texts per application) and is not intended for marketing campaigns. Outbound interview texts include notice that the recipient may reply STOP to opt out. Candidates may opt out via our consent preferences page, when rescheduling, or by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT; we process those replies and send a one-time confirmation. Reply HELP for brief program information. Our Privacy Policy describes collection, use, carriers (including Twilio), and opt-out. Carriers are not liable for delayed or undelivered messages; message and data rates may apply.
7. Credit-Based Pricing (if applicable)
Some features may operate on a credit-based system:
- Credits may be granted as part of onboarding or purchased
- Credits may be consumed for specific actions (e.g., job posting, candidate unlocking, AI analysis)
- Credits may expire or have plan-specific rules
8. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Aeviya and its licensors. The Service is protected by copyright, trademark, and other laws.

9. Service Availability
While we strive for high availability, we do not guarantee uninterrupted operation. We may suspend access for maintenance, updates, security, or other operational reasons.
10. Termination
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk to the Service or other users, or as otherwise required by law.
11. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, Aeviya will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or relating to your use of the Service.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or via email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
